"Mediation empowers parties to create their own solutions, fostering mutual respect and understanding, and often results in more satisfactory and enduring outcomes than court-imposed decisions."

Strategy

Laricelle employs a variety of strategies to help parties resolve conflict effectively. These strategies are designed to facilitate communication, promote understanding, and assist the parties in finding mutually acceptable solutions. She will listen attentively to each party, acknowledging their concerns and emotions without judgment. This helps build trust and ensures that each party feels heard and understood.

The over-riding aim is the facilitation of communication, encouraging open and respectful dialogue between parties. Laricelle will help parties to clarify misunderstandings, reduce miscommunication, and improve the flow of information. Maintaining a neutral stance, without showing bias or taking sides will ensure that all parties trust her and believe in the fairness of the process.

Execution

The key to a successful mediation is in its execution. Laricelle will identify Interests, not positions, helping parties move beyond their stated positions to uncover their underlying interests and needs. The purpose is to find common ground and facilitate solutions that satisfy the deeper concerns of all parties. Restating negative or contentious statements in a more neutral or positive way helps to reduce tension, shift perspectives, and focus on problem-solving rather than blame. Encouraging brainstorming and exploring a wide range of potential solutions identifies creative and flexible solutions that might not have been considered initially. Asking questions to help parties realistically assess the strengths and weaknesses of their case and the potential outcomes encourages practical and achievable solutions, and helps parties understand the risks and benefits of their options. Holding private, confidential meetings with each party (also known as "caucuses") supports the parties to explore sensitive issues, gather more information, and provide a safe space for them to express their concerns without fear of escalating the conflict. Recognising and addressing the emotional aspects of the conflict, reduces emotional barriers to resolution and helps parties focus on the issues at hand.

Assisting and Coaching

Building Agreements is the ultimate aim. Assisting parties in drafting a clear and detailed settlement agreement that outlines the terms of their resolution.
Laricelle will help to ensure that the agreement is workable, realistic, and understood by all parties, thereby increasing the likelihood of compliance.
Sometimes, mediators check in with parties after the mediation session to ensure the agreement is being implemented effectively to provide ongoing support and address any emerging issues, ensuring the durability of the settlement.
